Honkai: Star Rail Fan Creations Guide v2.0

Preface

Thank you for your interest in Honkai: Star Rail. In order to protect your creative enthusiasm and legitimate rights and interests, we hereby list and state the following matters related to the use of Honkai: Star Rail game materials and relevant fan creation.The provisions of this announcement will be updated from time to time. For the avoidance of dispute, the provisions of this announcement are not applicable to the Simplified Chinese version of Honkai: Star Rail (i.e. "崩坏:星穹铁道") published in the Chinese mainland or the Japanese version of Honkai: Star Rail published in Japan. Thank you very much for your support and enthusiasm for Honkai: Star Rail!

I. Overview

The copyright, trademark right, and other relevant legal rights of Honkai: Star Rail (hereinafter also referred to as “the game”) are owned by us. These include, but are not limited to, music, original artworks, and models.

Users can freely re-create publicly published contents from the Honkai: Star Rail series in forms including, but not limited to, text, images, videos, and physical objects. The following terms and conditions shall be observed during creation:

(I) The content created shall not violate any applicable laws, regulations, and policies, nor violate good social customs, nor harm the brand image and interests of us and/or Honkai: Star Rail.

(II) The content created shall not contain any inappropriate content (including, but not limited to, any controversial content or any content that may cause discomfort to others) or any content that is inconsistent with this announcement and/or inconsistent with the User Agreement of Honkai: Star Rail (see the official website of Honkai: Star Rail in each region for details);

(III) The content of the creation shall not be registered as a trademark in any country or region, nor shall any copyright be registered for or any patents applied for any fan creations and/or fan-made merchandise in any country or region.

The author shall be solely liable for any violation of the above terms or any infringement. For any works and acts that have caused or may cause damage to us and/or the Honkai: Star Rail game, we reserve the right to take necessary measures to safeguard our rights and interests.

II. Authorization of Fan-made Merchandise

When users create their own works related to the game, we provide different ranges of use and apply different rules according to the creation’s purpose, use mode, and sales scale (if any), as detailed below:

(I) The range within which the works can be used directly without authorization

1. Non-profit fan-made merchandise: refer to published original fan creations created independently by individual users and non-commercial teams, which are only used for non-commercial purposes (such as the purpose of communication between fellow enthusiasts), except as otherwise agreed in the rules.

2. Small-scale for-profit fan-made merchandise: refer to fan works that are created by individual users and teams, where a certain number of such works are made into physical forms and put on sale through online personal stores, offline exhibitions, or other channels, with the number of single-category products sold being less than [300] (exclusive) pieces.

The above two types of fan creations are within the range of direct creation and publication without requiring official authorization. Supplementary note: It is not permitted to make profits, whether online or offline, by mass production and sale of fan-made merchandise in the name of a company, studio, or other legal entity. For example, setting up stores on Amazon in the name of a studio or company or other entities, opening sales points in offline venues such as animation exhibition venues, or mass-producing unauthorized peripheral works for profit will be subject to official legal actions.

(II) The range within which the official authorization is required

1. For any form of for-profit fan-made merchandise related to Honkai: Star Rail, creators are required to contact us for authorization before production to discuss matters concerning further cooperation. For the avoidance of disputes, for-profit peripheral products refer to products that are produced on a large scale, commercialized, publicized and sold for high profit, with the sale quantity of single-category products greater than or equal to [300] pieces. To authorize such products, please send the following information to [honkaistarrail_cm@hoyoverse.com] for preliminary review:

• Creator's information: personal information, or the team’s creator-in-chief’s personal information (name, contact information, and address)

• Product name: the official name of the product announced to the public, such as "Honkai: Star Rail [March 7th] Fan-made Soft Glue Pendant"

• Total production: quantity and unit of products produced, e.g., "400 pieces"

• Unit selling price: the unit selling price of the products, such as USD 3

• Selling channel: the commercial channels where the products will be sold, such as e-commerce platforms, online store addresses, and offline exhibitions

• Product original materials: original materials used to design the product, such as illustrations and comics

• Copyright ownership proof: social media link containing the original images or blueprints, screenshots of the social media account homepage, etc.

• Characters to be authorized: characters contained in the original materials

• Product pictures: photos of the physical product or finished product designs.

If the product is deemed to require authorization from us after the preliminary review, we will make further communication to obtain the information required for authorization.

We reserve the right of prosecution against any for-profit products that have not been authorized by us after [60] natural days from the date of this announcement.

* The store listing and product name must match the name provided during registration. Please avoid using only product descriptors for the item name (e.g., "March 7th Plush Doll").

* Please note! All information provided by you will be kept confidential by the Honkai: Star Rail Project Team and will not be used for any purposes other than this authorization.

2. For authorized fan-made merchandise, the following rules must be followed by the released product page, any relevant supporting or publicity webpages, and relevant copywriting:

(1) The words [fan creation/fan-made] must be clearly visible on the product page.

(2) [Honkai: Star Rail Authorized Edition], [Official Cooperation] and other similar words of an official nature shall not be used in the product description.

(3) The images and design elements on the product details page shall not be directly used or partially changed, nor shall the official materials be modified.

(III) The range within which we will defend our rights

We will take measures to defend our rights in any of the following circumstances, including, but not limited to:

1. Extracting (including screenshots, as defined below) or copying and selling official materials (including original paintings, models, CGs, characters, monsters, and scene elements, as defined below);

2. Extracting or copying official materials, directly producing or partially modifying (including, but not limited to, tracing and modifying) official materials into peripheral products and/or publicity materials (including, but not limited to, designing and producing products or product details) and selling them for profit;

3. Selling products or carrying out other commercial activities under the guise of an official name;

4. Producing counterfeit official merchandise and other derivatives; (e.g. A sitting plush toy similar to those from Ichiban Kuji collaborations)

5. Other prohibited acts agreed upon in the Supplementary Q&A in this announcement, including, but are not limited to, the use of prohibitive words such as "shall not", "prohibited", "must not" and "cannot".

(IV) Supplementary notes

Q1: Can screenshots taken during the game be used for printing fan-made merchandise?

A1. Yes. However, this kind of merchandise is limited to the purpose of gift presenting and exchanges between fellow enthusiasts, and it is not allowed to charge fees for any reason.

Q2: Can I make figurines/clay products/mystery boxes/resin dolls (collectively referred to as "garage kit models") by making use of or making references to official graphics, such as game design and CGs?

A2: Yes. However, such garage kit models are limited to the purposes of free display, gift presenting, and exchanges between fellow enthusiasts only, and no fees shall be charged for any reason. Any commercialization involving sales shall be authorized and declared in accordance with the provisions of this announcement. Figures or models based on official illustrations will not be authorized.

Q3: Is official authorization required for publications such as fan fiction?

A3: No. To the extent that the contents of the above publications comply with applicable laws, regulations, policies, and good social customs, no official authorization is required for them, whether they are for profit or not (however, if the publications are accompanied by some physical fan-made merchandise given as gifts, then the fan-made merchandise shall be declared according to the authorization declaration process agreed in this announcement).

Q4: Do the 300 pieces mean all fan-made merchandise or a single product?

A4: They mean a single product, i.e. a single product category. For the avoidance of doubt, [category] refers to a product produced from original material and design, and category changes include, but are not limited to, a change in the design process or a change in production material. For examples:

1) Character 1 and character 2 are in the same fan-created image. If the two characters are split from the image to make single-person fan-made merchandise of the same specifications respectively, it will be regarded as fan-made merchandise of two categories made with the same original design and material.

2) If 150 badges (coated paper PET film iron bottom badges) are printed using one fan-created image and then 400 badges (flashing PET film iron bottom badges) are printed using the same image, it will be regarded as fan-made merchandise of two categories made with the same original design. In this case, a second declaration is required.

3) If 150 badges (coated paper PET film iron bottom badges) are printed using one fan-created image, then 160 more badges are printed by the same process using the same original design and material, it will be regarded as the fan-made merchandise of one category made with the same original design and material. In this case, since the number of such single-category products has exceeded 300, a second declaration is required.

Q5: Is it possible to authorize images involving multiple IP characters?

A5: If the product image involves multiple IPs, it cannot be authorized.

Q6: Can AI-generated images be used for merchandise production?

A6: AI-generated images violate the fan creation guidelines under the rule that prohibits "the extraction and sale of official content models for profit." Therefore, authorization will not be granted.

Q7: If an artist consigns their work to a seller, are they limited to consigning to only one seller, or can they authorize multiple sellers to sell their work simultaneously?

A7: Both are acceptable.

Q8: If I change the store name or product name for personal reasons, and customer service indicates that the product was not declared, what should I do?

A8: The store and product names must match the names declared at the time of submission. If changes are needed, you must resend the declaration email for re-submission.

III. Fan Creations

For the avoidance of disputes, Fan Creations refer to non-merchandise content resulting from the user's creation of publicly published content of the Honkai: Star Rail series.

Q1: Can users use the pictures, texts, or audio-visual materials of Honkai: Star Rail (hereinafter referred to as "Honkai: Star Rail materials") for fan creation (excluding any simple copying) and post them on a personal fansite or on any other website?

A1: We do not prohibit non-commercial personal use and you may, subject to all of the following terms and conditions, produce and publish derivative content based on Honkai: Star Rail materials for non-commercial personal use, except as otherwise agreed in this announcement:

1. You understand and agree that all rights (such as copyright, trademark right, and other intellectual property rights) of the Honkai: Star Rail materials are not transferred to you from us and relevant right holders, nor shall they be deemed as licenses and/or authorizations (including implied licenses and/or authorizations) in the legal sense. We reserve the right to exercise the aforementioned rights.

2. In case of aforementioned non-commercial personal use, please place both our copyright logo (such as "© All rights reserved by miHoYo") as well as make the following statement: "Other properties and any right, title, and interest thereof and therein (intellectual property rights included) not derived from Honkai: Star Rail belong to their respective owners." (Hereinafter collectively referred to as the "Legal Statement"). For the avoidance of doubt, you acknowledge and confirm that the Legal Statement does not apply to your creations. For details of the requirements for the creation of fan-made works, please refer to Article II "Authorization of Fan Creations" of this announcement.

3. If the Honkai: Star Rail materials used by you for fan creation involves character dubbing, character music, game music, sound samples, etc. in the game, please be aware that the aforementioned use shall be limited to non-commercial personal use, and the above-mentioned Legal Statement shall be placed. In addition, you are requested to confirm with the dubbing personnel and obtain adequate, legal, and valid authorization for your use of personal contents and related rights such as the voice of the dubbing personnel. For the avoidance of ambiguity, you cannot sell or distribute, for commercial purposes, any musical works containing Honkai: Star Rail music or character music (including, but not limited to, physical records, digital singles, and digital albums); your use shall be subject to the provisions of the Terms of Service of the Honkai: Star Rail game (see theofficial website of Honkai: Star Rail in each region for details). In addition, due to copyright protection restrictions on music platforms, we reserve the right to request you remove any content related to Honkai: Star Rail music materials at any time.

4. Please note that any legal liability arising from your violation of the above terms shall be solely borne by you. For any fan creation content or fan creation behavior that has caused or may cause damage to us or Honkai: Star Rail, we reserve the right to investigate your responsibility and we the right to take necessary measures to safeguard our rights and interests.

5. For the avoidance of doubt, if your published content consists of Honkai: Star Rail material that has not been officially published at the timeor contains the aforementioned unpublished material, you shall not use it in accordance with the above terms (even if the Legal Statement has been included). In this case, you shall be subject to the provisions of Q7 in Article IV "Supplementary Q&A" of this announcement.

Q2: Can users use officially released Honkai: Star Rail in-game footage (i.e. "Honkai: Star Rail in-game picture") to produce videos and share them on video websites?

A2: You may use the foregoing on the premise of observing all of the following terms:

1. Unless otherwise specified below, we require that the use of Honkai: Star Rail in-game footage must comply with the provisions of Q1 in Article III "Fan Creations" of this announcement, including, but not limited to, the use for non-commercial personal purposes only.

(1) You may use Honkai: Star Rail in-game footage to create videos, upload videos, livestream, and make profits on streaming websites, provided however that only the profit-making methods specified by us may be used and the content generated by you by using the aforesaid methods must comply with the provisions of this announcement. The current profit-making methods specified by us are limited to "partner programs on YouTube or other video and image sharing websites." We do not allow any other profit-making methods.

(2) You must not imply or represent that your video and/or webcast content is associated with us or sponsored, endorsed, or approved by us. In addition, if you want to use Honkai: Star Rail in-game footage together with the content (e.g., music, if any) for which a third party has intellectual property rights, you shall be solely responsible for obtaining adequate, legal, and valid authorization from that third party. If your aforesaid use is suspected of infringing upon the rights and interests of a third party, you understand that you shall handle and resolve the aforesaid disputes independently and bear all legal consequences arising therefrom, and that such consequences do not involve us and/or Honkai: Star Rail in any circumstances.

(3) If any video created by you and/or webcast content contains any in-game picture and promotional material of Honkai: Star Rail, please be sure to add your own creative ideas and opinions to them. We do not allow simple copying without adding your own creative ideas and opinions, e.g., the copying of promotional trailers, background music, gameplay sequences, or art collections of Honkai: Star Rail is not allowed. In addition, without our prior written permission, you shall not split or authorize any third party to split the content of Honkai: Star Rail into single materials (visual, sound, in-game elements, etc.) for any form of commercial use, nor shall any videos, music, images, or other contents produced by you using Honkai: Star Rail in-game picture be sold, given as commercial gifts, commercially authorized, or used for other commercial purposes.

(4) We reserve the right to remove any contents that we believe violate laws and regulations (including, but not limited to, infringement), are against good social customs, contain inappropriate content (including, but not limited to, controversial content or content that may cause discomfort to others), has caused or is likely to cause a negative impact on us and/or Honkai: Star Rail, or fail to comply with this announcement and/or the Terms of Service of Honkai: Star Rail (see the official website of Honkai: Star Rail for details).

2. The above standard for the use of Honkai: Star Rail in-game footage applies only to individual creators. The standard is not intended to be, nor shall it be deemed to be, an explicit official license or authorization for your use of our copyrighted content to create fan works.

3. The above standard for the use of Honkai: Star Rail in-game footage is not exhaustive and there may be matters not covered therein, and we will update the above standard from time to time. Before you publicly share any video content created on the basis of Honkai: Star Rail in-game footage, please first read, understand, and adequately refer to the latest content of the above-mentioned use standard. Please note that if you fail to comply with the above-mentioned use standard, we may take necessary measures to protect our rights and interests, including, but not limited to, removing your video content and disallowing you to use any Honkai: Star Rail materials.

Q3: I'm a Honkai: Star Rail creator, community MOD, or partner. Can I conduct online and offline activities in an official capacity?

A3: We strictly prohibit any third party from unilaterally, in any official capacity and/or official partnership (including, but not limited to, official cooperative manufacturer and official contracting personnel) identified by Honkai: Star Rail, conducting any online oor offline activities without authorization on behalf of the Honkai: Star Rail Project Team and/or us. If you have such needs, please contact relevant official Honkai: Star Rail personnel.

IV. Supplementary Q&A

Q1: How do users submit product-related comments or suggestions?

A1: We are very grateful to the users who have devoted invaluable efforts to Honkai: Star Rail for their suggestions. Q2: Can users register domain names and/or trademarks containing our name or part of our name, or the name or part of the name of our product, including but not limited to miHoYo, HoYoverse, and Honkai: Star Rail?

A2: We do not recommend this naming method because this method could easily mislead users to believe that the third-party domain name or trademark is or may be related to our official existence. If your registration infringes upon our rights and interests under local laws and regulations, we reserve the right to pursue your responsibility.

Q3: Can users provide the update program for Honkai: Star Rail on any website for the third party to download?

A3: No. In order to ensure the security of user accounts, we strictly prohibit you from providing any Honkai: Star Rail game program for downloading on any unauthorized third-party platform. If you are found with such action, we have the right to terminate all agreements between you and us, including, but not limited to, the User Agreement of Honkai: Star Rail (see the official website of Honkai: Star Rail for details). We reserve the right to reject any unauthorized setup, dissemination, or distribution of the Honkai: Star Rail update program by any third party at any time and under any conditions.

Q4: Can users translate the website of Honkai: Star Rail into a language version that does not currently exist?

A4: We allow information to be reproduced and quoted reasonably within the scope permitted by local laws, and reserve the legal right to pursue the responsibility of anyone who spreads or creates false information. In addition, please be aware that such third-party translation websites may cause confusion and mislead users of Honkai: Star Rail, and we have no control over the quality, accuracy, and authenticity of the translated contents on the websites.

Q5: Can users make or sell plug-ins for the Honkai: Star Rail game?

A5: No. In order to ensure the fairness of the game and the account security of Honkai: Star Rail, we strictly prohibit users from installing, using, or distributing any unauthorized plug-ins for Honkai: Star Rail. If any user is found with such action, we have the right to terminate all agreements with the user, including, but not limited to, the User Agreement of Honkai: Star Rail (see the official website of Honkai: Star Rail for details). We reserve the right to reject any unauthorized setup, dissemination, or distribution of plug-ins or other programs for Honkai: Star Rail by any third party at any time and under any conditions.

Q6: Can users set up private servers?

A6: No. Unless otherwise stated in writing by us, we do not support or permit you to set up any organizations or provide any services related to our products or events, and we do not allow simulation or redirection of our products through protocol simulation, channel creation, modification or addition of game components, use of existing or future applications or technical means, etc., regardless of the user's purpose, for commercial use or not.

Q7: Can users repost or otherwise use leaked content of the unpublished version of Honkai: Star Rail on the Internet?

A7: No. We hold complete intellectual property rights, ownership, and other related rights and interests in Honkai: Star Rail (including, but not limited to, game content), and we have the right to regulate the release of game-related content. In addition, if any unpublished version of Honkai: Star Rail is disclosed by a third party without our authorization and your reposting is based on such unauthorized disclosure, then we reserve the right to pursue your responsibility to the extent permitted by law.

V. Miscellaneous

(I) Please be aware that your fan creation shall be based on your understanding of Honkai: Star Rail and should be original fan content.

(II) For the avoidance of disputes, if you have signed a separate written agreement with us in respect of matters concerning the fan creation of Honkai: Star Rail, then the written agreement shall apply and this announcement shall serve as a supplement to the aforesaid written agreement. If the aforesaid written agreement is inconsistent with this announcement, the written agreement shall prevail.

(III) All creators are requested to abide by the provisions set forth in this announcement during active creation so as to avoid unnecessary disputes.
